1. Use of the Platform

1.1 Access

Use of HomLista is restricted to persons over 18 years of age who act for legitimate purposes related to the purchase, sale or rental of real estate.

By using the platform, you declare under oath that you meet this requirement.

1.2 Account Creation and Use

• You are responsible for the information registered in your account and for all activities carried out from it.
• Access to advanced features requires a complete and truthful profile.
• The following are strictly prohibited:
  • Creating multiple accounts without authorization.
  • Sharing accounts between multiple people.
  • Impersonating third parties.

📌 HomLista reserves the right to suspend, block or delete accounts that violate these rules or present fraudulent behavior.

1.3 Information Provided

You agree to provide accurate, truthful, complete and updated information.

HomLista is not responsible for:

• Errors or omissions in data provided by users.
• Damages arising from the use of false or misleading information.

2. Intellectual Property

All HomLista content (texts, images, codes, design, databases, logos) is protected by intellectual property laws.

• It is prohibited to copy, modify, reproduce or distribute any content without express consent.
• By publishing content (listings, photos, descriptions), the user grants HomLista a non-exclusive, transferable, royalty-free license for use in marketing, search engines, promotional campaigns, social media, etc.

📌 Any unauthorized use will be prosecuted in accordance with applicable law.

3. Third-Party Content and Liability

3.1 User Publications

All listings, comments or publications made by users or real estate agents are the sole responsibility of the publisher.

HomLista does not guarantee or validate the truthfulness or legality of third-party generated content. It is recommended to verify any information before completing a transaction.

3.2 Prohibited Content

HomLista expressly prohibits the publication of:

• False or misleading information.
• Photographs unrelated to the property (e.g., people, sexualized content, stolen images, third-party logos, QR codes, etc.).
• Visible contact information (phone, WhatsApp, social media) outside the designated fields.
• Offensive, discriminatory or illegal content.

📌 Publications that violate these rules may be removed without prior notice or refund.

4. Limitation of Liability

HomLista operates as an intermediary technology platform. It does not participate in direct real estate transactions nor guarantees the success of negotiations.

HomLista is not responsible for:

• Transactions between users.
• Financial losses, opportunities or indirect damages.
• Fraudulent acts committed by third parties.
• Technical errors, interruptions, hacks or network problems.

📌 The user accesses and uses HomLista at their own risk.

5. Suspension and Cancellation of Accounts

HomLista may suspend, block or delete accounts without prior notice if the user:

• Violates these Terms.
• Publishes prohibited content.
• Engages in abusive, fraudulent or illegal conduct.
• Damages the reputation or functioning of the platform.

📌 In such cases, no refunds or compensations will be granted.

6. Dispute Resolution

6.1 Mediation

Before any legal action, both parties agree to attempt an amicable resolution. Mediation will be confidential and may be conducted virtually.

6.2 Jurisdiction

These terms are governed by Mexican laws.

All disputes shall be submitted to the competent courts in Cancún, Quintana Roo, Mexico.

7. Personal Data Protection

Data processing is governed by our Privacy Policy.

By using HomLista, you authorize the use of your data in accordance with said policy.

8. Modifications

HomLista may modify these Terms at any time.

Substantial changes will be notified through the platform or via email.

Continued use after changes implies full acceptance.

9. Plans and Subscriptions

HomLista offers different service plans (free and paid), whose features, limits and prices are published on the official plans page: https://homlista.com/plans

• The Free Plan allows a limited number of listings and basic functionalities.
• Paid Plans (e.g., Agency Pro, Agency VIP) offer additional benefits such as more listings, premium features and visibility tools.
• HomLista may update, modify or discontinue plans at any time.
• Prices and benefits in effect at the time of contracting will be maintained during the current billing cycle.
• All paid plans renew automatically on a monthly basis until cancelled.
• The user is responsible for cancelling their subscription before the renewal date.
