This Compliance and Content Reporting Policy establishes the principles applicable to the prevention of illicit activities, the reporting of inappropriate content or behavior, and the measures that HomLista may adopt to protect the integrity of the Platform, its Users, and third parties.
This Policy complements the Terms and Conditions, the Privacy Policy, the Cookies Policy, the Refund Policy, and any other policy officially published by HomLista.
HomLista is a technology platform and may adopt reasonably necessary measures to prevent, investigate, and limit the misuse of its services, in accordance with applicable legislation.
2. HomLista's Commitment
HomLista promotes the responsible, ethical, and legal use of the Platform.
In order to protect Users and ensure a safe environment, HomLista may implement measures designed to prevent, detect, and investigate activities that could affect the security, integrity, availability, or proper functioning of the Platform.
HomLista does not tolerate the use of its services for illegal, fraudulent, deceptive purposes, or those contrary to applicable legislation.
All Users agree to use HomLista in good faith, respecting the rights of third parties and fulfilling the obligations set forth in these Terms and Conditions and other applicable policies.
3. Prohibited Content
It is strictly prohibited to publish, transmit, share, store, or distribute through HomLista any content or information that:
- Is false, misleading, or fraudulent.
- Infringes on intellectual or industrial property rights.
- Violates image or privacy rights.
- Contains defamatory, offensive, discriminatory information, or incites hatred or violence.
- Promotes illegal or fraudulent activities.
- Contains malware, viruses, or any malicious code.
- Impersonates another person or company.
- Violates applicable legislation.
- Could affect the security or stability of the Platform.
- Is contrary to these Terms and Conditions.
HomLista may remove, block, limit the visibility of, or delete any content it reasonably considers contrary to this Policy, with or without prior notice, when necessary to protect the Platform, its Users, or third parties.
4. Reporting Content or Illicit Activities
Any User or third party who considers that a piece of content, ad, profile, account, website, message, or any other element available on HomLista violates applicable legislation, third-party rights, or these policies, may report it to HomLista through official contact channels.
Requests must include, when possible:
- Identification of the reported content or activity.
- Description of the facts.
- Reasons why it is considered an infringement.
- Available documentation or evidence supporting the report.
- Contact details of the applicant.
HomLista may request additional information when necessary to properly evaluate the report.
The receipt of a report does not imply that HomLista acknowledges the existence of an infringement, nor does it automatically oblige it to remove the reported content.
Each report will be evaluated individually, based on available information, applicable legislation, the rights of the parties involved, and these policies.
HomLista may reject reports that are manifestly unfounded, abusive, repetitive, fraudulent, or made in bad faith, without prejudice to any legal action that may apply.
5. Intellectual Property and Copyright
HomLista respects the intellectual and industrial property rights of third parties and expects all Users to do the same.
Users will be solely responsible for ensuring they have the necessary rights, licenses, authorizations, or permissions to publish any content on the Platform.
The publication of content that infringes copyrights, trademarks, image rights, designs, databases, software, documents, photographs, videos, or any other right protected by applicable legislation is prohibited.
Any rights holder or their legal representative may request the review or removal of allegedly infringing content through HomLista's official channels, providing the information and documentation that reasonably proves their ownership and the alleged infringement.
HomLista may remove, limit access to, block, or delete the reported content when it reasonably considers there are sufficient indications of a possible infringement, without this implying an acknowledgment of liability by HomLista.
When appropriate, HomLista may inform the affected User and allow them to present any clarifications or documentation they deem relevant, unless applicable legislation or a competent authority provides otherwise.
6. Impersonation and Fraud
HomLista expressly prohibits any attempt at impersonation, falsification of information, unauthorized use of third-party data, or any other conduct designed to deceive other Users or the Platform.
Among other behaviors, the following will be considered prohibited:
- Creating accounts using false identities.
- Using the name, logo, or trademark of third parties without authorization.
- Publishing properties without sufficient authorization.
- Using falsified documentation.
- Generating fraudulent Leads or interactions.
- Attempting to manipulate the Platform's statistics, positioning, or features.
- Using automated tools for illicit purposes.
- Any other action intended to obtain an undue benefit or harm HomLista or third parties.
HomLista may implement prevention, detection, and verification mechanisms designed to protect the security of the Platform and may suspend, limit, or cancel accounts when there are reasonable indications of fraud, without prejudice to applicable legal actions.
7. Cooperation with Authorities
HomLista may collaborate with judicial, administrative, regulatory, or any other authorities when there is a legal obligation, an order issued by a competent authority, or when necessary to protect the rights, security, or legitimate interests of HomLista, its Users, or third parties.
Such collaboration may include, when legally appropriate:
- The temporary preservation of information.
- The delivery of information required by a competent authority.
- The preventive suspension of accounts or content.
- The adoption of measures designed to prevent illicit activities.
- Any other action permitted or required by applicable legislation.
HomLista will only provide information to the extent legally appropriate and in accordance with the applicable Privacy Policy.
8. Measures HomLista May Adopt
In order to protect the security, integrity, and proper functioning of the Platform, HomLista may adopt, at its sole discretion and when there are reasonable grounds, one or more of the following measures:
- Request additional information or documentation.
- Verify the User's identity.
- Limit certain features.
- Temporarily hide content.
- De-index publications.
- Temporarily suspend an Account.
- Permanently cancel an Account.
- Delete content that violates these policies.
- Block access to certain services.
- Report facts to competent authorities when appropriate.
- Exercise corresponding civil, administrative, or criminal actions.
- Adopt any other measure reasonably necessary to protect HomLista, its Users, or third parties.
The adoption of any of these measures may be carried out with or without prior notice when HomLista reasonably considers it necessary to protect the Platform, prevent damage, comply with a legal obligation, or avoid misuse of the services.
The adoption of these measures will not generate a right to compensation, damages, refund, or any claim by the User, unless applicable legislation expressly states otherwise.
